A Notary Public is an official appointed by the government to serve as an impartial witness in the signing of important documents. They are responsible for verifying the identity of the signers, ensuring that they are signing willingly and knowingly – and that the signatures are genuine, of course. Notaries are also tasked with maintaining a record of the notarized documents, which can be used as evidence in legal proceedings. The primary function of a mobile notary is to perform notarial acts, and here are the most common.
- Acknowledgments: One of the most common services provided by a notary is taking acknowledgments – a process that involves verifying that the person signing a document is indeed the individual named in the document and that they are signing it willingly. Acknowledgments are often required for documents such as deeds, powers of attorney, and other legal instruments.
- Jurats: A jurat is a type of notarization in which the signer swears or affirms that the contents of the document are true. The notary administers an oath or affirmation and then witnesses the signing of the document; jurats are typically used for affidavits and depositions.
- Oaths and Affirmations: A notary can also administer oaths and affirmations, which are formal promises to tell the truth. This service is often required for legal affidavits, depositions, and testimonies.
- Copy Certification: Notaries can certify that a copy of a document is a true and accurate reproduction of the original. This service is often required for official records, such as birth certificates, marriage certificates, and academic transcripts.
- Signature Witnessing: Another service a notary can provide is witnessing the signing of a document. Unlike an acknowledgment, the signer does not need to acknowledge that they signed the document willingly; the notary simply confirms that the signature is genuine.
